Welcome to TweakTrail, accessible via TweakTrail.com (the “Website”). These Terms of Service (“Terms”) govern your access to and use of the services provided through the Website, specifically the resume creation platform known as the Application. By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Application.

1. Acceptance of Terms of Use and Amendments
Each time you use or access the website or any of its subdomains, you agree to be bound by these Terms, and as amended from time to time with or without notification.
In addition, if you are using a particular service on the website, you will be subject to any rules or guidelines applicable to those services and they shall be incorporated by reference into these Terms.

2. Accounts To access premium features, users must create an account with a username, password and an optional valid email address. Users are responsible for maintaining the confidentiality of their login information and for any activity under their account. Users agree to immediately notify us of any unauthorized use or your registration, user account or password.

3. Data Storage and Security

Data entered into the Application is stored locally in the user's browser by default
If a user makes an account, account information is securely stored in a database
If a user makes a premium payment, resume data is securely stored in a database and encrypted
Personal information stored for account creation and payment processing is handled in accordance with our [Privacy Policy]

4. Payments

Premium access to the Application requires a one-time payment via a third-party provider (e.g., PayPal).
Each payment grants access to premium features for a specific duration, as indicated at the time of purchase. After this period, access will expire unless renewed with a new payment.
Premium access is not a subscription and will not renew automatically.
All payments are final. Refunds are not provided.

5. User Content Users retain ownership of the content they add to resumes. By using the Application, users grant the provider permission to store and process this data solely for the purpose of delivering the service.

6. Acceptable Use Users agree not to misuse the Application, including but not limited to:

Attempting to gain unauthorized access to systems or accounts
Uploading unlawful, harmful, or abusive content
Disrupting or interfering with the normal operation of the Application

7. Analytics and Tracking The Application uses anonymized analytics to understand usage patterns and improve performance. No personal data is used for tracking

8. Termination We reserve the right to suspend or terminate access to the Application for any user who violates these Terms.

9. Disclaimers and limitation of Liability The Application is provided "as is" without warranties of any kind. We are not liable for any direct, indirect, or incidental damages resulting from your use of the Application.

10. Indemnification You agree to indemnify and hold harmless the provider of the Application, including its affiliates, officers, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including reasonable attorney’s fees) arising from your use of the Application, your violation of these Terms, or your infringement of any third-party rights.

11. Governing Law These Terms are governed by and construed in accordance with the laws of the Netherlands and applicable EU regulations.
